Terms of Service

1. Parties
These terms govern the provision of aerial content and technical aerial services by Algarve Visual Content Studio, Lda. ("Studio") to the client identified in the applicable project agreement or booking confirmation ("Client").
2. Services
The Studio will provide the services described in the booking confirmation or service agreement. Scope changes must be agreed in writing. The Studio reserves the right to refuse any brief that conflicts with EASA or ANAC regulatory requirements or the Studio's editorial standards.
3. Scheduling and weather
Shoot dates are confirmed subject to weather conditions. The Studio will reschedule at no additional cost if conditions prevent safe or quality-standard flying. The Studio accepts no liability for delays caused by weather, airspace restrictions, or events beyond its reasonable control.
4. Payment terms
For single-project work: a 50% deposit is required to confirm the booking; the balance is payable upon delivery of the final assets. For subscription services: monthly fees are invoiced in arrears, payable within 14 days. Late payments accrue interest at the Portuguese statutory commercial rate.
5. Intellectual property
Upon receipt of full payment, the Studio grants the Client a perpetual, worldwide, non-exclusive licence to use the delivered files for commercial purposes. The Studio retains the right to include the work in its portfolio unless the Client requests confidentiality in writing prior to the shoot. All underlying intellectual property rights remain with the Studio.
6. Access and permissions
The Client is responsible for ensuring that the Studio has lawful access to the shoot location and that any necessary landowner permissions have been obtained. Airspace authorisations are handled by the Studio. The Studio reserves the right to abort a shoot if access or safety conditions are inadequate, without refund of the deposit.
7. Limitation of liability
The Studio's aggregate liability to the Client for any claim arising from a project shall not exceed the fees paid for that project. The Studio is not liable for indirect, consequential, or economic loss. Third-party liability insurance of €1,000,000 is maintained for all commercial operations.
8. Governing law
These terms are governed by the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Faro, Portugal.
